2. Collection and storage of personal data as well as type and purpose of their use
2.1. When visiting the website
When you visit our website www.burmester.de, information is automatically sent to the website server by the browser used on your terminal device. The following information is temporarily recorded in a so-called log file without your intervention and stored until automated deletion:
- IP address of the requesting computer,
- Date and time of access,
- Name and URL of the accessed file,
- website from which the access was made (referrer URL),
- browser used and, if applicable, the operating system of your computer as well as the name of your access provider.
The aforementioned data is processed by Burmester for the following purposes:
- Ensuring a smooth connection setup of the website,
- Ensuring a comfortable use of our website,
- evaluation of system security and stability as well as
- for further administrative purposes.
The legal basis for the data processing is Art. 6 (1) sentence 1 letter f DSGVO (General Data Protection Regulation). The legitimate interest follows from the purposes for data collection listed above. In no case will Burmester use the collected data for the purpose of drawing conclusions about your person.
In addition, Burmester uses cookies and analysis services when visiting the website. Please refer to the more detailed explanations in sections 4 and 5 of this privacy policy.
2.2. When registering for our newsletter
If you have expressly consented to this in accordance with Article 6 (1) sentence 1 letter a DSGVO, Burmester will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an e-mail address.
Unsubscribing is possible at any time, for example via the link at the end of each newsletter. Alternatively, you are welcome to send your unsubscribe request at any time by e-mail to mail@burmester.de.

For questions of any kind, Burmester offers you the possibility to contact us via a form provided on the website. In doing so, it is necessary to provide a valid e-mail address so that Burmester has the information from whom the inquiry originates and in order to be able to answer it. Further information can be provided voluntarily.
Data processing for the purpose of contacting Burmester is based on your voluntarily given consent in accordance with Article 6 (1) sentence 1 letter a DSGVO.
The personal data collected by Burmester for the use of the contact form will be automatically deleted after completion of your request.

Burmester will only disclose your personal data to third parties if:

- the disclosure is necessary for the assertion, exercise or defense of legal claims pursuant to Article 6 (1) sentence 1 letter f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
- in the event that there is a legal obligation for disclosure pursuant to Article 6 (1) sentence 1 letter c DSGVO, as well as
- this is legally permissible and required under Article 6(1) sentence 1 letter b DSGVO for the processing of contractual relationships with you.
4. Cookies
Burmester uses so-called cookies on the website. These are small files that your browser automatically creates and that are stored on your end device (laptop, tablet, smartphone or similar) when you visit the website. Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware.
In the cookie, information is stored that arises in each case in connection with the specific end device used. This does not mean, however, that Burmester gains direct knowledge of your identity.
On the one hand, the use of cookies serves to make the use of the website and Burmester’s offer more pleasant, e.g. by using so-called session cookies to recognize that you have already visited individual pages of our website. These session cookies are automatically deleted after you leave the website. In addition, Burmester uses so-called temporary cookies – also to optimize user-friendliness – which are stored on your end device for a certain fixed period of time. If you visit the website again, it is automatically recognized that you have already been a visitor to the website and which entries and settings you have made so that you do not have to enter them again.
Finally, Burmester uses cookies to statistically record the use of the website and to evaluate it for the purpose of optimizing the offer for you (see section 5). These cookies make it possible to automatically recognize that you have already been to our website when you visit it again. These cookies are automatically deleted after a defined period of time.
The data processed by cookies is necessary for the aforementioned purposes to protect the legitimate interests of Burmester as well as third parties in accordance with Article 6 (1) sentence 1 letter f DSGVO.

However, the complete deactivation of cookies may mean that you cannot use all functions of the Burmester website.
5. Analysis tools
5.1. Tracking-Tools
The so-called tracking measures listed below and used by Burmester are carried out on the basis of Article 6 paragraph 1 sentence 1 letter f DSGVO. With the tracking measures used, Burmester wants to ensure a demand-oriented design and the continuous optimization of the website. On the other hand, the tracking measures are used to statistically record the use of the website and to evaluate it for the purpose of optimizing the offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

5.2. Google Analytics
We use Google Analytics, a web analytics service provided by Google Ireland Ltd, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (hereinafter “Google”). Google Analytics uses cookies to identify the frequency of use of certain areas of our website and preferences. The information generated by the cookie about your use of our website (including your shortened IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information on our behalf and on the basis of an order processing agreement in order to evaluate your use of our website, compile reports on website activity for us and provide other services relating to the use of services and the internet.
Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law.
We only use Google Analytics with IP anonymization enabled. This means that the IP address of users is shortened by Google within member states of the European Union (EU) or in other contracting states of the Agreement on the European Economic Area (EEA). Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your internet browser will not be merged with other data from Google.
If you do not wish to have Google Analytics analyze and measure your website’s reach, you can specifically deactivate the use of Google Analytics cookies using an Internet browser add-on as an alternative to the options presented by Cookie Consent. You can download this here: http://tools.google.com/dlpage/gaoptout?hl=de. In this case, a so-called “opt-out” information is stored on your end device, which serves to assign your deactivation of Google Analytics. Please note that such “opt-out” information only leads to a deactivation of Google Analytics for the end device and the relevant Internet browser from which it was set. In addition, you may have to set it again if you delete cookies from your end device.
5.3. Google Adwords Conversion Tracking
In order to statistically record the use of our website and to evaluate it for the purpose of optimizing our website for you, we also use Google Conversion Tracking. In this process, Google Adwords sets a cookie (see section 4) on your computer if you have accessed our website via a Google ad.
These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer’s website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.
Each Adwords customer receives a different cookie. Cookies can therefore not be tracked across Adwords customers’ websites. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking.
The Adwords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.
If you do not wish to participate in the tracking process, you can also refuse the setting of a cookie required for this – for example, via a browser setting that generally disables the automatic setting of cookies.
You can also disable cookies for conversion tracking by setting your browser to block cookies from the “www.googleadservices.com” domain.

6. Social media plug-ins /Google Maps/Google reCaptcha
Burmester uses so-called social plugins of the social networks Facebook, Instagram and Pinterest on the website on the basis of Art. 6 para. 1 p. 1 lit. f DSGVO in order to make BURMESTER better known via these. The underlying promotional purpose is to be regarded as a legitimate interest within the meaning of the DSGVO. The responsibility for data protection-compliant operation is to be ensured by their respective providers. The integration of these so-called plugins by BURMESTER is carried out by means of the so-called two-click method in order to protect visitors to the website in the best possible way.
a) Facebook
The website makes use of Facebook social media plugins to personalise the use thereof.
To this end, BURMESTER uses the “LIKE” and “SHARE” buttons. These are offers from Facebook.
If you retrieve a page from the BURMESTER website, which contains such a plugin, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser, and incorporated into the website by the same.
By integrating the plugin, Facebook receives the information that your browser has accessed the corresponding BURMESTER website page, even if you do not have a Facebook account or are not currently logged into Facebook. This information (including your IP address) is sent directly from your browser to a Facebook server in the USA and is stored there.
If you are logged into Facebook, Facebook can directly assign the visit to the website to your Facebook account. If you interact with the plug-ins, for example by clicking the “LIKE” or “SHARE” button, the corresponding information is also transmitted directly to a Facebook server, where it is then stored. The information is also posted on Facebook and shown to your Facebook friends.
Facebook can use this information for purposes of advertising, market research and the demand-oriented design of Facebook pages. To this end, Facebook creates usage, interests and relationship profiles, e.g. to evaluate your use of the website with regards to the pop-up advertisements displayed on Facebook, to inform other Facebook users about your activities on the BURMESTER website and to provide further services associated with the use of Facebook.
If you do not want Facebook to assign the data collected via the BURMESTER website to your
Facebook account, you must log out of Facebook before visiting the website.

b) Instagram
The BURMESTER website also makes use of so-called plug-ins from Instagram, which is operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”).
The plug-ins are identified by an Instagram logo, for example, in the form of an “Instagram camera”.
If you access the BURMESTER website, which contains such a plug-in, your browser establishes a direct connection with the Instagram servers. The content of the plugin is transmitted by Instagram directly to your browser and is incorporated into the website. By means of this integration, Instagram receives the information that your browser has accessed the corresponding BURMESTER website page, even if you do not have an Instagram profile or are not currently logged into Instagram.
This information (including your IP address) is sent directly from your browser to an Instagram server in the USA and is stored there. If you are logged into Instagram, Instagram can directly assign the visit to the website to your Instagram account. If you interact with the plug-ins, for example by clicking the “Instagram” button, the corresponding information is also transmitted directly to an Instagram server, where it is then stored.
The information will also be published on your Instagram account and be shown to your contacts.
If you do not want Instagram to assign the data collected via the BURMESTER website to your Facebook account, you must log out of Instagram before visiting the website.

c) Pinterest
BURMESTER also uses a so-called plug-in from the Pinterest social network, which is operated by Pinterest Inc., 808 Brannan Street, San Francisco, CA 94103-490, USA (“Pinterest”).
If you access the BURMESTER website, which contains such a plug-in, your browser establishes a direct connection with the Pinterest servers. The plug-in thus transmits log data sent to the Pinterest server in the USA. This log information may include your IP address, the address of the visited website, which also contains Pinterest functions, the type and settings of the browser, date and time of the request, your mode of use of Pinterest and cookies.

On the website, Burmester integrates the maps from “Google Maps” services provided by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA.
The processed data may include, in particular, your IP address and location data, but may not be collected without your consent (in most cases within the framework of the settings on your mobile device). The data may be processed in the USA.

e) Google reCaptcha
To protect the information you offer via an online form, BURMESTER makes use of the reCAPTCHA service provided by the company, Google Inc. Google) (see d).
The query is used to distinguish whether the entry is being made by a human or improperly by means of automated, mechanical processing. The query includes the sending to Google of the IP address and, if necessary, any further data required by Google for the reCAPTCHA service. To this end, your entry is transmitted to Google and further used there. By using reCaptcha, you agree the identification you offered being digitised. Where IP anonymisation is activated on this website, your IP address is however abbreviated in advance by Google within the member states of the European Union or in other contracting states to the agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and be abbreviated there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser in the context of reCaptcha is not associated with any other data held by Google. For such data, the divergent data protection provisions of the company, Google, are applicable. 7. Rights affected
As a user of the website, you have the right:
- to demand information about your personal data as processed by Burmester GDPR, in accordance with Article 15 GDPR. In particular, you may demand information pertaining to the processing purposes, the category of the personal data, the categories of recipients, to whom your information has been disclosed or is being disclosed, the planned storage duration, the existence of a right to rectification, deletion, restriction of the processing or objection, the existence of a right to appeal, the origin of the data, provided that this was not collected at Burmester and on the existence of automated decision-making including profiling and, if necessary, meaningful information on the details thereof;
- to demand the immediate rectification of incorrect data or the completion of your personal data stored at Burmester, in accordance with Article 16 GDPR;
- to demand the deletion of your personal data stored at Burmester unless the processing is required for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims, in accordance with Article 17 GHPR;
- in accordance with Article 18 GDPR, to demand the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you reject the deletion and Burmester no longer requires the data, but you require this for the establishment, exercise or defence of legal claims, or you have lodged an objection to the processing in accordance with Article 21 GDPR;
- to receive the personal data, which you have provided to Burmester, in a structured, common and machine-readable format or the transmission to another responsible body, in accordance with Article 20 GDPR;
- to revoke your once-given consent vis-à-vis Burmester at any time, in accordance with Article 7(3) GDPR. This has the consequence that Burmester may not in future continue with the data processing, which was based on this consent and,
- in accordance with Article 77 GDPR, to lodge a complaint with a supervisory authority. In general, to this end you can turn to the supervisory authority of your usual residence or workplace or the company headquarters of Burmester.
8. Right of objection
Insofar as your personal data is processed on the basis of legitimate interests in accordance with Article 6 (1) Clause 1 (f) GDPR, you have the right, in accordance with Article 21 GDPR, to lodge an objection to the processing of your personal data to the extent that reasons exist, which arise from their specific situation or that the objection is directed against direct marketing. In the latter case, you have a general right of objection, which is implemented by Burmester without a specific situation being disclosed.

9. Data security
During the visit to the web site, Burmester uses the popular SSL (Secure Socket Layer) process in conjunction with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, recourse is taken to 128-bit v3 technology instead. You can see whether a single page of the Burmester internet presence is being transmitted in encrypted form from the closed representation of the key or padlock icon in the status bar of your browser.
